New Family Code safeguards the best interests of minors

Nuevo Código de las Familias salvaguarda el interés superior de los menores

Florida, Sep 13.- The right to life, survival and development, to participation, non-discrimination and respect for the best interests of children is explicitly endorsed in the new Cuban Family Code , in a full display of support for international criteria and the provisions of the Constitution of the Republic.

In accordance with the norm that will be submitted to a referendum on September 25, children and adolescents in the family environment have the right to be heard, in accordance with their capacities and progressive autonomy, to make decisions that concern their interests within the home, to receive accompaniment and guidance, and to live in an environment free of violence.

Any family wishing for the normal growth and happiness of their children will agree to the obligation to guarantee their physical and mental integrity, health care, education, food, upbringing and general well-being, together with access to play and other recreational activities. their age, all of which is reflected in the new regulation.

Said basic institution is ultimately responsible for ensuring that children and adolescents have access to the real enjoyment of these and other concepts related to their well-being and quality of life.

The Cuban Family Code does not deny or deprive parents of rights over their children, but it does reinforce the country’s commitment to international treaties, which define the inviolability of children’s access to full physical, mental and social development, to express their opinions and to be heard in their family environment.
